Failure Investigation
When an accident occurs, a common initial reaction is to blame the vehicle. It's human nature. So how can you tell when the vehicle truly failed mechanically? The first thing you should do is call us. We can perform a Failure Investigation on any (or all) vehicle(s) involved and provide guidance to you and your legal team.
Comprised of several individual components, our Failure Investigation can be as simple or as complex as you need it to be. Our base-fee includes the essential elements you need. Many clients find their needs fulfilled by our comprehensive failure investigation, but you may find your needs are more complex or financially threatening...

» Step 1: The Physical Examination (aka "The Exam") (included in base fee)
What we do:
We will completely look over the vehicle for evidence of mechanical failures and document all problems found. This includes a visual inspection by our Hall-of-Fame technician as well as an interrogation of the on-board computer system. We will document any areas where the vehicle does not meet current Federal Motor Vehicle Safety Standards (49CFR571),Federal Inspection, Maintenance & Repair Standards (49CFR396) as well as state safety inspection standards.
We will then provide you, within 96 hours of completion, documentation of our findings. This documentation includes:
a written report of findings,
precise, high resolution photos* of any issues/areas we identify as non-compliant,
and as a courtesy, we can also provide support documents from state and federal agencies that can provide legal traction for your case.

» State Inspection Fraud
when someone pays a mechanic to "overlook" problems and provide a valid inspection sticker.
when a car dealer places a valid inspection sticker on an unsafe vehicle in order to sell it.
» Federal Inspection Fraud
(note: federal law does not provide "inspection facilities" for truck or trailer inspections and blank inspection stickers are easily available. This system leaves many gaps for abuse.)

» Body Installer Fraud (note: many trucks are built on the assembly line as an "incomplete chassis". A body installer will then place a body of the customer's choice on the chassis and the installer must then certify it meets federal requirements by placing a label on the cab. However, there is no "final inspection" and many body installers incorrectly certify trucks as meeting federal law.)
A used truck dealer installs a body on a 29,000lb GVW truck chassis and recertifies the vehicle for 26,000lbs to increase it's resale value, placing the vehicle illegally below the CDL threshold.
» Failure to Maintain
A trucking company installs manual brake adjusters in lieu of original equipment automatic slack adjusters during a brake re-line. The vehicle is now in violation of federal law.
» Improper Repair
A mechanic installs a DOT approved plastic/nylon air brake tubing in place of a broken front wheel brake hose or uses compression fittings for copper tubing on air or hydraulic brake systems.
» Fitness for Purpose
A 18,000 lb GVW dump truck is loaded with 10,000 lbs of stone and pulling a loaded 9,000 lb Bobcat trailer.
» Improper Salvage
A stress cracked frame is welded.
» Defeated / Missing Safety Systems
A truck with air brakes is fitted with a pintle hook trailer hitch. The installer provides air hose connections (gladhands) for the trailer by tapping into the truck's rear brake system lines.
» Illegal Modifications / Alterations
A truck has heavier springs installed to increase the GVWR of the vehicle.
Wetake all photos with a very technically advanced digital camera that allows us to achieve extremely close-up views of many components. (Think of being able to view a hand-sized electronic circuit board as if it were the size of an Olympic pool...)
